Yeah, I debated Med Mal as well. Which actually isn’t THAT far away from what this is.

Countersuing would be smart from a legal perspective, but make sure you weigh the side effects.

Oh man, really sorry about this, Menace. Sad You have my complete support.

I do think you should consider counter-suing; if anything, the legal costs can skyrocket and you do have yourself to look after. Like FM said, you can’t afford missteps, however well-meaning you are.

Hope it goes well and ends well!

Luckily, the time to counter-sue has already come and gone for me. I had to decide months ago if I was going to, and - frankly - I would never have forgiven myself if I even pursued that option.

Before I get into the why of that one, let me say that the deposition was extremely rough, and taxing on me. I tried to maintain my composure, but after a solid hour of, well, interrogation, I pretty much lost my temper. He asked me the question, "so what do you think about all of this?"

My answer? "I think this is ridiculous."

"Why is that?"

"Well, imagine with me for a second that you save someone’s life, someone who you don’t even KNOW that well. And then imagine that person coming back and BLAMING you for everything, dragging you through a lengthy court process, all the while threatening to kill you and your family. Yeah. Pretty ridiculous."

And then there was this gem-stone:

Lawyer asks me, "Have you talked to anyone about the incident?"

"Well, yes. My friends and my family."

"More specifically?"

"[List of a bunch of names]. And last week at my church group I gave my testimony."

"What’s a testimony?"

"A testimony is where I stand up in front of everyone and speak about my life, the difficulties I’ve faced, and how it’s all helped shape my faith."

"And why did this come up?"

I scoffed. "You know, you don’t save someone’s life and then have them blame you for it without having a lasting effect on your faith. Make sense?"

---

I walked out afterwards a fine combination of furious and emotionally "to the wind" (that’s how I described it to my dad). I feel completely empty.

And back to why I chose not to counter-sue. It isn’t because I didn’t think I could get some money out of it (I know I could get a LOT), but because of two specific reasons: First, that I want this to end as quickly as possible. Second, because I myself was the "victim" of a car accident (in fact, just over a month before this whole crappy incident). I had to go to the hospital for my injuries (I headbutt the windshield at 40mph). My dad pressured me to get some money from it; I wound up with $15,000 or so.

I didn’t want it, so this summer I spent all of it. Doting on my friends, buying canned goods to donate, and generally spoiling myself (and making several "contributions" to CobraCards, hehe).

Yeah, I’ve been on both sides of this kind of battle, and I wish I didn’t have to fight at all. The only thing I want to do is be able to sleep tonight so I won’t have to call in sick tomorrow for work.

But that isn’t happening. *le sigh*

Thanks for all your support though, fellas. This is easily the most difficult week of my life, and it helps enormously having good people giving good help.

When I came to Abraham I let him live just a moment longer. When I came to Moses I saved his life more than once. But the salmon... I regret to say I had a hand in its death.

Who am I?

Wow, sounds like it was pretty rough.
I do think your reasons for not counter-suing are good.
So what is the next step in this whole process?
